A friend of mine brought up an interesting question today. We both agreed that if a cop were to find rolling papers in your car that would be probable cause for them to search the car, being drug paraphernalia. BUT what if you were to tell the officer they were for tobacco and show him a pouch of tobacco, and/or some rolled cigarettes? Would that still leave probable cause to search the car? And I don't want anyone saying "if you have nothing to hide, what difference does it make" because the difference it makes is A. I like my privacy, and B. I don't want to waste the time its going to take him to search my car. And yes i know if a cop really wants to, he'll find a way to search it anyway.

rolling papers wouldn't necessarily constitute probable cause. rolling papers and residue in a pipe would. finding or smelling a minute amount of marijuana would give you probable cause.
Yeah, rolling papers alone are not drug paraphernalia.

Just as they said, papers alone are not probable cause. The papers themselves are not paraphernalia unless there is some drugs to go with them.

the may or may not be probable cause, but i got my car searched for a platic bag.
the bag even had peanut butter left in it from my lunch.
cops will always find a reason to search your car if they really want to search it.

one time i got pulled over and when i was trying to get my license a little baggie fell out of my pocket...
but wait!
it was the baggie that i had my screws in from the temperature guage that i just installed.
i offered to hand it to him and showed him the guage...
he said 'oh thats fine'
long story short, i had no proof of insurance (i do have insurance, just didnt have the recent paper in my car), cracked windshield, and the initial reason i was pulled over was because of my stereo...
anyway he let me go

damn skippy they will find away ....this happened to me when i was in ky for my visit back i was in a s10blazer w/fl tag i got pulled over for going 10 over on the highway and i met the cop at the back of my truck ...he told me to wait in the truck and he will run my shit ..so after half an hour he can up to my window and told me that my blazer is coming back as a van (yea right)and that it will be a few more mins .....to which another cop showed up and they both came up to my widow and asked me out and to step to the rear (well fuck what did i do now )then the first cop told me that he need to search my car cause he thinks he smelled pot (yea right i have not thouch that shit since i was 18 i am 30 now and i met him at the back of the truck at first)so i told him to go ahead look and u shall not find ...so after an hour and tearing my truck apart he came back and gave me a ticket for 10 over and said have a nice day .........all because i had fl tags in ky
