I am sure most of us have seen the person who is trying to sell car in the "for sale trade" site just how legal is this? When I sold a car before and call the DMV they told that in Texas it is illegal to sell a car without an title. Has this changed?

you can't sell it without a title. the title has to be signed over to the new owner upon purchase. you can file for a lost title. some people sell cars with an open title where the person buying doesn't sign it in front of the seller. i've seen car dealerships do this. they sell them for cash to illegal aliens. i worked a wreck where a guy did this and the illegal wrecked the car then ran off. since the title was still registered to this guy at the dealership he was responsible for the damages caused by the accident.

My friend bought a car from an older lady. She had long lost the title to the car she she wrote him out a bill of sale and had 3 witnesses sign it saying that she sold it to him. He took the bill of sale to the courthouse and got a title for it no problem.
