we've been having a discussion lately about troopers, because this guy who claimed to be a trooper said he'd write us a ticket out of uniform for speeding.
someone said it doesnt matter if he's in uniform or not, he can ticket you. someone else said that he can't write the ticket, he has to call an officer in uniform to write the ticket, but he can hold you there until the uniformed officer gets there. the second one makes more sense to me, simply because i heard you can beat a ticket where the trooper is not in full unifrom (i.e., if a uniformed cop gets out of his car without his hat).
yall tell me the answer.

well, i don't know how that law is written in your area, but once i issued a kid six tickets one day out of uniform. i am a cop 24-7 so sayeth the state. not that i go around looking for shit when i'm off duty, but sometimes people seriously need to be placed in check.

I don't know if its actually true or not, but there used to be an ex statie that called some talk radio station in boston telling people how to beat tickets and that was one of the things he said, a trooper w/out a hat is out of uniform and the ticket is void... of course that only works if he had the camera on or you have a full car (what is it, the word of 1 cop is worth that of 2 or 3 people?)

Just as Bullit said 24/7. Don't confuse being out of uniform (those are only department rules) vs. failure to identify yourself as a police officer.

"no hat". just as good as that "i made it home and you cant write me". 24 hours a day, 365 days a year, for 20 years. but off duty you can only write someone who commits an offense, in your presence, in your area of geographical employment, ie. village/town/city/county/state. and nope, no ones ever pissed me off enough.... yet
p.s. yes, sorry firecop, was speaking of traffic violations only. misdemeanor committed in my presence anywhere in state, felony, with probable cause, anywhere in the state.

I can write someone in my town for a witnessed offense and anywhere in the state for a witnessed felony.

i can file traffic offenses off duty anywhere in the state. it just has to be filed with the court that has jurisdiction.

Here any off-duty out of uniform Peace Officer traveling in his Police vehicle, marked or unmarked has the authority to pull you over and call in the local agency to cite you at any time in the State.
Now this is where a lot of people get confused, they think State Troopers or State Police only have authority on State Highways. A State Troopers jurisdiction IS the entire State (except Indian Res. and Military bases). So yes, if that off duty State Trooper was working here or his policies are similar to ours he could do what he said and cite you for anything anywhere in the State.
Most Officers don't like to drive thier work cars off duty as while you are driving your depts car you are a representative of that agency and are required to enforce the law and also to stop and help any stranded motorists. (which you don't always want to do.. say if your family is in the vehicle.)

In my little town the cops dont bring their cars home. theres not enough. If one of them came up to me ouot of uniform and off duty and tried to give me a ticket id probally tell him to go shit in his hat.

Im very familar with the rules and regulations of the schp, and yes he can write you a ticket not being in uniform... If he has a state cruiser with bluelights and a ticket book, he can write you.
