1. What constitutes reasonable cause? What is the legal definition of reasonable cause? Is this something an officer just has to say in order to justify searching a car without permission; or is this something that can be disproven in court.

2. While I am pretty sure( TC, Bullit a little confirmation if you please.) that radar detectors are legal here in Texas, Are they legal where you serve? If not, are you able to detect them? I have seen detectors that claim VG-2 technology (invisible from detection.) and the really cool ones that scramble the signal sent back to the radar gun. Are these legitimate claims on the part of the detectors?

3. How often do you guys switch back to the old K-band detectors just to mess with the guys who only pay attention to X-band signals anymore? ( I figure this one should be the entertaining answer.)

Thanks
Robert

well, there are two different types of reasoning for a stop. one is probable cause. this is basically a reasonable person's belief that a criminal offense most likely occurred. then there is reasonable suspicioun. this is where a reasonable person would believe that a crime has been committed or is about to be committed. i'm in the process of moving or i'd give you my book's definition.

radar detectors are legal. if you have one and i see it i will follow you all over my city turning my radar off and on to drive you nuts. it's something i take great amusement from. anything that scrambles a radar signal is not allowed at all because it can interfere with aircraft instruments and other things. it doesn't matter if i clock you or not, i can still write you for speeding. to give you an example of a radar's uses.....a scottish police officer went to a rural highway to work a traffic detail. he observed a harrier jumpjet flying above. thinking it would be fascinating to clock the speed of the jet, the officer pointed his radar at the plane and proceeded to clock it's speed. the computers and the pilot immediately recognized the radar's signature and instantaneously armed a missile and locked onto the location of the radar source. after the pilot decided to ensure that there was not a threat present he discovered the officer with his radar gun. the police dispatcher was promptly notified by the military that in the future it would not be a wise move to clock heavily armed military aircraft.

NEVER! why would you need to? i've written hundreds of speeding tickets to people who were actively making use of a radar detector. now, why would i need to use an older, less powerful radar band?

your welcome,

chris

To catch a few points that Bullit missed, VG-2 is excellent. It doesn't make itself "invisible" to radar, it merely detects a radar-detector-detector and shuts itself off until the signal is gone. It's only usable in the few states that don't allow detectors.

As for searching a car without permission, the legal standards are actually pretty low for that since the courts have held that your expectation of privacy is far less in a car than say in your home. Really the only time I use this is when I see items that I'm sure are stolen or I smell weed in your car. In either of those cases, I'm going to search your entire car without your permission.

Hope that clears a few things up. http://www.3rdgen.org/ubb/smile.gif

And, if I'm not mistaken, the X-band radar is the old one.....and I don't even know of a department with X-band. We're all K or KA band now.
