PA- police impounded my vehicle for seemingly no reason [Archive]

I'm in Chester county, PA.

I'll try to be brief here:
I am outside the delivery area for my favorite pizza shop, so I told them to deliver it to this Honda dealer thats about halfway between my house and the store. I'm waiting at the dealer lot (its closed and after dusk) and a cop shows up, asks me what I'm doing.n I told him the truth, waiting for a pizza. He frisks me, tells me my story doesnt make sense, and detains me in the back of his police car. Calls backup, two more cops show up, search around the area, they find nothing unusual. They get the manager of the dealership to come in and confirm theres no break-in or vandalism and whatnot. Cop comes over asks me if he can search my car, I say no. He asks me for my cell-phone, I say no. Meanwhile the pizza guy shows up, they detain him for a half hour and then let him go, without me having paid for the food because Im in the back of the cop car. I get pissed and lit a cigarette in the back of his car, and smoke most of it being careful not to burn anything and carefully ashing on my pizza coupon that I had. He tells me to get out of the car, says "who told you you could smoke" smacks the cigarette out of my hand. I said that he didnt say I couldnt smoke so.... Anyway, they then said that I was tresspassing, told me my vehicle was being impounded so start walking home. I did so, and the next day they called to tell me to come get my car. I get there and have to pay a $75 fee to get the car. My question is was the cops justified in impounding my vehicle or no? I seem to remember something about an illegal search & seizure or something to that effect. The gate to the lot was open and a few other people had came and went, to drop off cars or whatever. They were not harrassed or assaulted like I was. I should have just lied to his crooked ass and told him I was dropping off my car (87 Civic) and waiting for a ride. I am extremely mad about this. If I had a magic wand that could make this guy drop dead, I wouldnt think twice about it. He'd be dead. Sorry if I need to vent that but thats how I feel. Anyway, was the impound of my Civic justified?

ok, youre being harassed by the cops, so you decide to light up in THEIR car?if its a dealership, it is private property, so thats all the cop has to say.plus, you dissed the law by smoking in the cruiser.(not to mention u were in a civic)

anyhoo, id say no. you wernt causing damage or anything, and while they were suspicious, they didnt find anything (right?) and they didnt have anyone from the dealership complaining(right?) i would persue legal action because they outed you $75 for no reason. that, and file a report on the cop...

now, if they didnt take your car, but just harassed you, i wouldnt do anything... but at this point, i would.

Dude, the prick cost me a pizza and I was fuggin HUNGRY. Dont mess with a man's pizza. It was a four-cheese, too. That bastard. After I saw that I wasnt going to be eating my pizza as planned, I needed a cigarette to supress my appetite, and also to calm my nerves so I wouldnt break this guys nose and end up in a ish-load of trouble. (Not to mention a beat-down) Damn straight I dissed the law, fuck em. If they didnt want me smoking in the car well then he shouldnt have put me in the car with my cigarettes. And about my Civic, it's a reliable beater that goes to and from work while I'm in between cars right now whilst I work on some debt. It starts every morning and I havent changed the oil once in the 10,000 miles I've owned it. In fact, theres rarely ever any oil in the thing, but it still runs like a top. Its not the first Honda Ive owned and Ive noticed that Hondas arguably dont need any oil to run LOL. But dont diss my beater, it does its job and will run all week on $5 worth of gas.

Anyway, no I didnt damage anything; I just wanted a damn pizza. I may have done my share of vandalism when I was young and dumb, but I'm too old for that shit now and I havent been into the stupid kid shit in years and years. In fact, I'll smack a vandal if I catch one anywhere near my shit, and then restrain him until the cops arrive to haul him away. And no, they didnt find anything. There was nothing to find. Except for a delicious four-cheese pizza. But even so, I probably wont do anything about it, thats just gonna make the asshole mad and he'll then be looking for me to bust me for jaywalking, or spitting in public or whatever. I just wish I had a magic wand. Id get even with the guy then. And while I m at it I'd give myself a 10 inch penis, why not? LOL

The prick said I would recieve a citation for tresspassing in the mail (and he said it with a little smirk on his face, no bullshit) and I have not recieved it. I dont think its coming, which is kind of why I'm not pursuing any action against him. At face value the situation doesn't sound right. I can only make two guesses on this:

1. There was what appears to be a serious abuse of the 4th amendment and you should consult an attorney (I've seen similar situations, thought not quite as severe as the one you told); or

2. You're leaving something out because certain details would be embarassing to discuss.

As for the trespassing charge, that won't float. For one, if you're in the parking lot out front that the public has access to and there are no signs prohibiting entry during certain times, you're not trespassing (keep in mind that I'm speaking purely off knowledge of the Texas Penal Code, though most states' laws are very similar). In Texas, the signs would have to be posted all over the place or you would have to have been told, in the presence of a peace officer, not to return to the property.

One thing to consider, though. If you do decide to sue the department or city, keep this in mind. Cities have very deep pockets and usually will fight you tooth and nail in courts. Then if you lose, you're stuck with legal bills that will bankrupt you for life. You're in sort of a Catch-22 it sounds like.

Like I said, I'm out of thier delivery area. Not just a little bit over the cut-off line, but a good 3-4 miles out of it. They would not have delivered it to my house no way in hell. And the Honda dealership was the only address I could think of that was inside thier range and I knew the name of the street. In retrospect, I should have either went a little further to pick up the pie, or lied to the cop and said I was dropping off my vehicle, since that would have made sense and apparently the truth didn't make much sense, to him anyway. Oh, and it had to be this particular pizza shop because I had a coupon for a free large pizza (the same coupon I used as an ashtray in the patrol car.) Yeah, I knew that lighting up would anger the dude, but when I'm hungry as I was that night I don't think straight for some reason. And I guess I also wanted to be somewhat rebellious to the corrupt police officers violating my rights, so... Oh well

I just saw a thing on Dateline NBC where the cops were being corrupt as usual and someone complained about it to the supervisor but he was basically threatened and told that he'd be filing a false police report and his complaints weren't heard at all. Its been 3 weeks to a month now so I think its too late

Hang on now, just cuz a cop was a dick to you doesn't mean he's corrupt. he could be a damn fine peace officer who doesn't take bribes and protects the people.

Man I'm 25 they'll draft someone younger before they take me. But, um, no, I wasnt rude or anything until he had detained me for 45 minutes and my pizza was gone. That was when I started to get pissed. Oh, and this guy was most certainly corrupt. The way he smacked my hand was definitely an assault; he did it because he could see that I was mad and I think he thought there was a good chance I'd hit him back. He wanted to try and make me do something REALLY dumb, so the three of them could have a jolly good time kicking my ass and taking me to jail. Or worse, they might have wanted to shoot me, who knows? All three cop cars were parked so the cameras couldnt see what was going on, how convienient. I dont think they wanted to kill me really, but they definitely wanted to kick my ass thats all I know.

if they were all conveniently off camera, then why would they need an excuse to beat you up?

and why would him slapping a burning cancer stick (that you just smoked in his car) out of your hand mean he's corrupt? did his list of people who bribe him fall out of his pocket when he did it?

but seriously, if it was that bad, pursue action against him. file a complaint. and dont use "it's too late" as an excuse. that's just the easy way to rationalize letting him get away with it.

They were all convieniently off camera, but they're not just gonna start beating me because they dont like the looks of me, right? He wanted to provoke me into doing something that would UNQUESTIONABLY give him the right to use force. It's not like I'm black or something. Hehee thank God I'm not black it wouldve been that much worse.

And just because certain individuals don't take bribes or whatever doesn't mean that they aren't a part of the most corrupt organization I've ever personally seen. So the lesson learned is... I guess don't order pizza, and lie to the police whenever truth would make less sense than fiction. In fact I shoulda told him that I hadn't driven, I wasnt anywhere near my car when he stopped me. I'm personally gonna lie to the police whenever possible from now on.
