ok.. i have to ask this..

i got hit in a parking lot yesterday by some one who was backing up..

anyway the story goes like this.. i pulled into a parking lot behind this guy and watched him go into park in his spot.. i saw the reverse lights flash like an auto would.. anyway.. i stop just to make sure he wasnt doing anything so i start to go to another empty space.. well when i got behind him i saw his reverse lights kick in and (like every normal person would do) i hit the gass to try and keep him from hitting me. therefore increasing my speed in the parking lot. well instead of hitting the entire driver side of my car he hit the back fender, the back part of my door, rear bumper, put a slash in my tire, and took a chunk out of my rim. well anyway. his insurance company is saying that i was speeding through the parking lot and that they are not going to cover the repairs to my car.. the damage is at least 3k (his trailer hitch did most of the damage) but anyway.. i know that since it was on private property that a cop would not be able to do anything but am i in the wrong of how his insurance should cover my car? some one please help me figure this out.. caus i really think im ending up getting it up the ass here.. and it doesnt feel very nice.. :cry:

Tell the insurance company that regardless of speed, because THERE IS NO FUCKING SPEED LIMIT IN PARKING LOTS, their client backed up when it was unsafe to do so. Also tell them that your neck is starting to hurt and you're considering hiring an attorney to settle the suit for you if they're unwilling to assist you.

They'll get the drift.

Just what TC said. A letter from your attorney wouldn't hurt either. Ask his insurance company where to send your medical bills. Like TC said your neck and back are KILLING you.

Scare them into spending more money on health reasons, and they are sure to pay the low payment of 3k, maybe even more.

thanks guys. but i tried the oh my neck hurts thing and they still wont..normally my family doesnt have this problem

Letter from your attorney. Or file suit against them, normally (if you're in the right) the insurance company is going to pony up the bucks before going to trial. It's cheaper to give you 5K then it is to defend the case.

Definitely file a suit. Teach this insurance company a very valuable lesson. They exist to steal our money, the bastards.
