handcuffing on a traffic ticket

i bought my car from wisconsin and drove it all the way to georgia.. well i called the insurance company and had the insurance put on the car b4 i left.. it just so happens i drive almost all the way home with a "tag applied for" on the back .. then i get to tara blvd . it was actually jonesboro cops . they pull me over less than 3 miles from my house.. keep in mind i drove all the way from wisconsin and got pulled over twice ... i showed illinois police department my ticket where i flew in ... and the title which the guy signed where he was supposed to print and printed where he was supposed to sign lol (he just wasnt payin attention more into the money i guess).. well illinois cops said it was fine with them ...i just need to get the title fixed.. i got pulled over by wisonsin cops too they said same thing.. go figure... it was alright with them it was obvious what was goin on .. i bought a car and drove it back (which when i got pulled over by wisconsin police they talked for like 30 mins about there 69 camaro and all this... : ) .. cool guy... but jonesboro cops said i stole the car and forged the signatures on the title and that i had no proof of insurance... or tag... that "tag applied for" doesnt work and is illegal to use cuz im sayin i applied for the tag when i havent yet.. well i show them my airplane ticket... and tell them the story.. they rip up the airplane ticket.. ( i kept the ripped ticket for evidence just in case) .. i showed them recipets from where i bought gas... and they just kept sayin i was lyin.. then they said i was drunk... and i told them i wasnt... and to give me a breathalizer if they didnt believe me that i would fully comply with one... they refused to give me one... put me in handcuffs... told me i was drunk.. that they were impounding the car... and they had called a tow truck driver... well i was sittin in the back of the car... like 8 cops pulled up when they pulled me over.. and one stood up to the old prick that was actin retarded.. and took over.... told the old guy to go home... and took me out of the car and unhandcuffed me ... they younger guy who uncuffed me told me to drive the car home and park it till i got proof of the insurance or we would go through a big ordeal for nothing... cuz i had insurance just no proof ... ie. insurance card... i realize what they are doing im 19... and i bought a 400hp camaro.. and they were tryin to scare me ... by handcuffing me and the whole ordeal.. i mean im not stupid.. if they were going to do somethin they would have done it .. they were just scaring me... but the questions i have is the following :

1. Is it technically legal to handcuff on a routine traffic stop ?

2. They checked the car thoroughly and didnt find anything of course... but is legal to do so without any even notion that i might have somethin ?

3. Is it possible for me to do somethin about this... as in complain about the old cop guy who was givin me the problems

4. is a tag applied for in ga actually illegal or where they b.s'in ?

5. is it legal to handcuff me and say im drunk without even giving me a breathealizer ?

6. should i do somethin about this.. or because i didnt get a ticket just let a slide ? even though they prolly could have impounded the car just for the hell of it and they drop the ticket when i go to court cuz i just didnt have proof.. and me be outta $200 bucks...

i figure the old senile cop will get his in the future and to just let it go ... that its not reallie worth the whole ordeal if i didnt even get a ticket or actually arrested ? ? wHADDYA THINK ? ive been so freakin paranoid and demoralized by the whole thing that im to freakin scared of bein harrassed to even drive on the street... i drive to work back home that is it... to much driving just brings up to high of a risk of one of those police officers pulling me over just to harrass me because im young.. and the thought that one of them might actually try to arrest me for somethin i didnt do and have to go through a huge ordeal because of it... just freaks me out

1. yes you can, but i wouldn't make a habit of it, ie personnel complaints

2.if the vhicle wasn't properly registered/insured and they were going to impound it yes. its called an inventory search

3. you could talk to his sergeant/superior and ask what the basis was for "your treatment"

4. not familiar with that. here you can apply for a in transit permit that allows you to drive from point A to point B, nothing else. the segeant/superior you talk to should be able to answer that

5. yes if he believed you were drunk. a breathalyzer test is usually administered at the station,not at the scene.

6. same answer to #3.

i just got pulled over this morning by the same cop... he calls me a little punk and to get off his streets... i told him i have just as much of a right to be here as he does.. he gets pissed searches my car again... and tells me next time he pulls me over her wont be so leniant ? .. and im thinkin to myself i havent done anything... so what is that supposed to mean ? ... hummmmmmm.... if he pulls me over again... its startin to sound like harrassment to me... is there anything i can do about harrassment ?

Yeah I would at least talk to his chief or something. There is no way that he should treat you like that. He cannot search your car either unless he sees something or smells something or is going to tow it for some reason. If he finds anything it cannot be used against you in court. (if you don't consent or he doesn't have reasonable suspicion) Next time you get pulled over and you are in an uncomfortable situation with the officer ask for a supervisor.

I have had some pretty crappy experience with my own town police too. I have been harassed by them 4 times and each time I wasn't doing anything wrong. 1st time I parked in a parking lot cause McDonalds was full ran and got some food and got a ticket for "parking on private property without owners consent" They wrote a due date of May 0 on the ticket so I put it off. Soon enough I got a notice in the mail that the fine had doubled. I received the ticket a couple of days before May. I went into the station and asked them what it was all about and the guy says "lemme see this" he takes it back and writes a 1 in front of the 0. I was pissed so I filled out a mediation form and explained there was no other parking available so I parked in that lot. They replied and said that I should have parked basically in the same lot. After my mom called from the sheriff department and did a lot of bitching to them I didn't have to pay it. 2. Car is parked in driveway. There is snow on the ground and I come out and there is a ticket stuck in the door. It says "no vehicle registration". I see footprints walking up to my plate, but there is no plate # written on the ticket. I call the department because this is a bs ticket because it is on private property, I have plates and it was written by a CSO, who can't even write those tickets. Called the department and complained again and then I had to go to the department and sign some stupid form. Big hassle. 3rd time. I am coming home from somwhere and decide to stop somwhere to eat. There are a ton of ricers at mcdonalds down the street. I avoid all the BS and go to Taco Bell. Friend pulls in and I talk for like 5 minutes, turn around to get food and a cop pulls in front of my car and gives me a ticket again for "Parking on private property without owners consent" Signs in the parking lot say that you can't be there for more then 30 minutes without getting food. I was ther for 5 and the officer knew it. Filled out a mediation paper and the seargent says I should have eaten and then left immediately. The lady at the desk says that I shouldn't have been ther because I have a trans am. I ended up paying the $50 parking ticket.
4th time.. The other day I come home from school at night, park my car in the garage and put it up on jacks. I was putting a bolt back in for the sway bar. Walked to my neighbors house and let out his dogs. I saw a car fly by, but thought nothing of it. 45 minutes pass and I am working on my car when I hear on my police scanner that an "unknown type of vehicle is doing an excess of 100mph down my street" It was on the opposite side of the block though. Anyway to make a long story short, cops see me, run my plate and I walk up nice and friendly to help them out. Officer starts screaming at me accusing me of doing it, calling me a lier and that a "complainent" saw me doing it. I ask him what kind of car did they say and he looks over at my car and says "a red trans am" I ask if I can see it on the computer and he says its "confidential information" Then asks if I am calling him a liar. I was calling him a liar pretty much cause he was. It was an unknown vehicle. Basically there were 2 cop cars in front of my house making a huge scene for 30 minutes and my mom came out and was talking to them and mentioned that I was going into law enforcement. He says I know nothing about it and that it isn't the job for me and I should try going on some ride alongs. That pissed me off because I have been in law enforcement classes for the last 2 years and have been on at least 7 ride-alongs. I don't know everything, but I know a lot. They left later and my neighbors verified that they saw 3 ricers racing down the street. I called them back and told them and my neighbor told them what they saw and also told them that I never speed on my street. I know better.
Anyway I am really cool with cops and stuff, but my town just plain sucks. The officers lie all the time and are really accusitory. All of these times I haven't done anything wrong and I am being harassed. Each time they do this it makes me not want to be a cop. When that cop said that I shouldn't be a cop I just wanted to tell him that his officers need to learn some Community Policing strategies and not treat their residents like shit.
Sorry this is so long, but I am really upset about this. None of this should have ever happened.

yea there is always good cops sometimes.. i know a few.. there is alot more assholes tho.. police seem to think because they are in uniform they can say and do what they want.. always stick up for each other when they know they are lying..& carry guns, this sounds alot like the worlds biggest gang to me lol cops usually just always have authority issues.. you make them think you are scared, and that they are in control .. usually you can get away with small offenses.. its all about making them feel like they rule!
sounds alot like my neighbors they all hate me.. call up and complain to the county about anything and everything.. settin the timin a 1pm with it idle... say its too loud.. i have an rearend in my backyard i havent got rid of yet thats hidden behind my barn.. call the county get me ticketed.. assholes suck

I have had the local cops on my back for years now (not many cars here like mine!) and finally I went to the station and talked with a higher-up guy. He told them to lay off and I haven't had a problem since!

Yes he can put you in handcuffs and in the back of the police car, in SC everytime someone is pulled over they are considered to be 'under arrest', btut hey dont go to jail much in this case. Its more o the right to hold someone until we can complete whatever we are doing however we CAN take someone to jail for going 2mph over the limit techinicially but noone does. And we can hold them for any reasonable amount of time to get to the bo ttom of things, like making sure a car is not stolen or has insurance. ect But usually whenever i put someone in handcuffs dureing a routine stop, is if i feel its for the intrest of my safety. LIke im out numbered, they are bigger, or its a bad part of town at 2am, they appeared to not want to stop the car at 1st, ect.

All of this reminds me of a time that my friend and I were driving north on 156th street. We were stopped at a light, about to change and all of a sudden we see a little taurus gun it from twent feet back in the lane next to us. Now just past the light, the street changes to a one way, so we decide, oh hell no, this is our street and so, he gives it soem gas on up to 45 and blow past the taurus. Well, all of a sudden the taurus hits the brakes, jumps in behind us and we see the cherries come on. :roll: Undercover cop. So we pull off on a side street, he gets out, looks us over, two 18 year olds in a 2002 Mustang GT, and so then asks if he can search the vehicle. All he can find is a 1mil candle power flashlight .. why? Because we didn't have anything. He then approaches us and says were you boys trying to get me to race? I was going to piss myself laughing any second now so my buddy Ted replies, no, we were just heading home. So he sits there for a second and all of a sudden you hear one of the loudest peel outs of your life back at that intersection, he tells us to stay put and goes to check it out ... moron didn't see anything, and comes back. Well, he then tells us that reving your engine up high can be taken as a sign that you want to race(no shit). So he "lets us off with a warning" and tells us to head home. We laughed long and hard about us racing a taurus as we cruised around a little more. :thumbup:

go to a lawyer's office and show up at his department headquarters with your attorney or a written letter and demand to speak to the chief,and hand over to him your lawyers letter basically saying if this pattern of harrasment continues that you will seek legal action against this cop , and while your at it file a complaint. the reason why he acts that way is because no one takes action against him. :roll:

Mabey in the lounge. But the law enforcement portion is a more professional non-BS area. Cops are held to sa high standerd and so is this section. I hope whoevers originial question got answered.
