View Full Version : The Illinois judicial system can SUCK IT!

I went to court this morning on the suspended license charge and the loud muffler ticket.

I show the prosecuter the paper work and the suspension ticket is dropped. I then plead not guilty to the loud muffler and get a trial.

The cop states his side and then I get mine. As I was asking my questions, the judge interrupts me and says to ask my question. I told her I am getting to it. I state that his complaint ticket is based on his opinion on what is a "loud muffler" with no basis of factual proof, like a decibal reading, to prove that the exhaust is indeed "loud".

The judge says "The officer is out there all the time, he knows what is a loud muffler." I said "It is still his opinion based on no hard proof. This cannot be a guilty charge."

The crooked Judge says "$150 fine and guilty charge!"

I stated that this is impossible w/o actual proof and asked her to state the law.

She says it doesn't matter and it stands.

I was very angry at this point.

(Here is my mistake...)

I mumbled under my breath "This is total busllsh!t" under my breath and she heard me. D'OH!

"Did you just say "bullsh!t in my courtroom?"

"I said yes. I am angry at the decision and I mumbled it under my breath and I am expressing my opinion, just like the officer did with my loud muffler"

Now the fine is $500.

I realized I screwed up by uttering the word "bullsht", but when a loud muffler ticket can be proven by the offiers OPINION w/o any hard evidence, then that is total bullsh!it.

So, To the Illinois Judicial system, including the above named judge and the Officer of the Hoffman Estates Police department and the Cook County Circuit Court:

THEY CAN ALL SUCK IT!

No, you cost yourself the money. Sounds like you went in with a bad case of 'tood.

Do you know what the law states? Not being a dick, I just want to know, because if you did you could have used the law to your defense. But you don't EVER ask a Judge about their knowledge of the law.

After a quick google search, the law states the exhaust can not me more than 95 decibles in Illinois. Assuming you planned on fighting the ticket, you should have come to court prepared.

All you needed to do was have it tested. I'm sure some radio installiation shops (or something like it) will have a meter to read decibles, either that, or you can buy something at radio shack to read the decibles, and have a wittness. Take it to court if you have to.

then when you are up there, you can present evidence showing your car was not over the legal rate. But going up against on officer with nothing on your side is like fighting a losing battle.

and save the cursing until after you're out of the room next time ;)

Why didn`t you just pay the $75.00 fine and not worry about it. It isn`t a moving violation so it doesn`t go against you in any way.

I do realize the errors of my ways. I got frustrated and lost control, which I rarely ever do. The fact that this judge was extremely disrespectful to me and my defense is what put me over the edge.

I hate the fact that in traffice court, one is guilty until proven innocent. I stated that THE COP had no hard evidenceother than his opinion that the muffler is loud. I said that is unacceptable. The police office who writes the complaint should be the one to back up his story with the eivdence that I am guilty, not the other way around.

Unfortunately, it does not work this way. I realize that police officers are doing their job, but when the deck is automatically stacked against the alleged offender with out any way of getting out, I see that Police officers and The court system is unjustly robbing the public. Sure, the police are necessary to keep the peace of the public, but they are also pretty good SALESMEN on bullshit offenses to generate revenue for the city by harrassing the people to make money for BULLSHIT tickets like this.

I was hit by a Cook County Sherriff who was responding to a call and was negligent is his operation of the vehicle. It was clearly his fault and I was never reimbursed for my expenses, even after my insurance company sued the County.

Sorry, but I now officially dislike and do not trust ANY police officer and the court systems. I will think twice to ever ask for their assistance on any matter other than traffice accidents or items that need their report to resolve. I will not be flagrant or abusive with any police officer and will co-operate with them as needed, but have ABSOLUTELY NO TRUST IN THEM WHATSOEVER.

Sorry, but I have been wronged by the system too many times. Not every time, but too many times.

You obviously need an attitude adjustment. The things they have to put up with are amazing. I would not become a cop, myself, because I don't think I could put up with the abuse they face every day. The cards are not stacked in their favor at all! Just the opposite! I agree the judicial system sucks, but for the oposite reason. I've seen so many guilty people get off for the stupidest reasons! You went in that courtroom with no respect for them and you wanted them to respect you?!? He shoulda given you a night in the tank!!

I have to say i have and will proudly plead guilty to a noise violation ticket cause of my muffler out here it was only 75.00 and i got out of the point shit or whatever.

It is messed up that the judge went on the officers opinion only. You could have been better prepared before going in there but still the judge was not just in this case . A family member just went to traffic court and won against a lying cop. This person had a witness(passenger) and the officer stated he had his lights on because he was respondng to a disturbance call. When asked if he had his lights on (meaning it was an emergency) why did he not repond to his initial call he totally looked lost(BUSTED)!! His answer was because it was only a disturbance call . Then why feel the need to turn on his lights if it is only "disturbance call". The witness testified that the office never had his lights on. The ticket in question had to do with the yielding the right of way to an emergency vehicle or something to that effect. The ticket was dismissed .

Dylan, the Illinois law states that a muffler cannot be modified or installed to amplify the noise from your exhaust. I hope that your muffler is not louder then stock, because then it would be illegal.

You shouldn't lose your trust in cops though because of a few occasions. Sh*t happens sometimes. Hanover Park tries to screw me all of the time. I keep getting BS Illegal tickets even though I have never been pulled over by them. I observed and and learned that their department was total bs. I was offered a possible job in the office their, but I won't participate in their crap. On the other hand I know plenty of officers who are really nice. When they get to the scene when something happens they really don't know much. They gather info and evidence from what people tell them and then the investigation. You then have to prove yourself in court. I have been let off of 2 different tickets for speeding 15 over, going through a yellow, loud exhaust (cut-out open). The other time was for squealing the tires. I was let off for both for being really polite about everything so they didn't think I was some punk kid.
The cop had no choice when the dispatcher told the cop that your license was suspended.(even though it was a mistake) He had to arrest you. He probably just got you on the muffler to have a reason to pull you over and investigate and something to take you to court on.
