OK.. The other night my b/f dropped me off and after that he went to meet one of his friends in the windixie parking lot. the next thing him and his friend know is that there are like 5 cops surrounding them. they never looked at his friend eric's truck but the cops were laughing at my b/f's car and were REALLY rude to him and eric. They blaimed my b/f of street racing, reckless driving, running from the cops in a residential neighborhood, and being out past cerfew. he was out past cerfew but thats not acriminal offense. the main thing though is.. he had proof that he wasnt street racing at the time the cop said he was because we were at walmart and they could pull up the security vidoes not to mention i had the reciept for what we bought but i wasnt there so i couldnt show them. and they blamed him of running from the cops when at that time we were at 711 getting black and milds, they could check the cameras there too, but the other thing about the running from the cop thing is that they had the tag number for a nissan sentra when he drives and altima. the only thing that he was in the wrong about was the cerfew but they didnt care about the details of the wrong tag for the chase. and they still cuffed him and put him in the cop car. the whole time they were rude to eric also b/c he was nice to the cop until the cop slammed the door to his truck on his arm. then he got rude and called my b/f's parents to get them up there. they let eric go but josh's dad had to come up there and talk to the cop to let him out of the car. but he's hung up on the fact they didnt read him his rights when they cuffed him or anything. and they blamed him of things he didnt do. he just wanted me to ask what he can do to have the cops that were there and blamed him of things they didnt have any proof of. does anyone know about something like this happening or what can be done about it? :shrug: OH! and if they didnt read him his rights cant he have everything dismissed because he did get a ticket for the cerfew BUT it has the reason that he was out past cerfew and then another part of it has a totally different reason. cant he have all of that dismissed somehow? :crossed:

I'll ignore the foad. I can't speak for Fl but in CT you do not have to read anybody their rights for a witnessed crime (in this case the curfew). As for the accusations of racing etc., no need for rights either because he was not under arrest for racing.
Maybe they were rude but they didn't do anything they could get in trouble for.
Remember you are judged by the company you keep.

thanks for the info. but they werent even with anyone else. his altima looks stock and doesnt sound like a ricer car and his friend drives a dodge ram thats raised. so i dont get why they would think that they were doing anything wrong :conf:

you only are required to read somone their rights IF you are going to question them about the crime/offense. as far as the curfew thing that's not a criminal charge, usually just a fine or something. if he was out past a certain time, without a good reason, then he's out of luck.

Reading this post was difficult.
Did they arrest him? I doubt it. Sounds more like they detained a minor for being out past curfew, and called his parents. Standard stuff.
What does he want to be dismissed? This is a civil infraction, not a criminal offense.

I work here in Florida. There is a difference between arresting and detention. If the officers felt for whatever reason that he may run or start swinging then they have every right to cuff him. Some of the police stations down here have the policy of anyone that is in the back of the car will be cuffed.
If he didn't get any citations then what are you trying to get dismissed?
What a lot of people don't know is that when you get cut a break... take it. If you were speeding and you got a seat belt ticket just pay the ticket and get it over with cause officers have the right to "ammend the citation". So if your b/f wants to get charged with everything possible then go ahead and fight it. If not I would just let it go.
Believe it or not it is not a requirment for officers to know every model of vehicle. Just being a Nissan could have given him reason enough to stop.

slam door on anyone's arm weather you are a cop or not someone will more than likely start swinging..(not me though im a pacifist you couldnt make me hit someone ;) (self defense in my opnion) whether its right or wrong legally... morally it is... to throw accusations and threats... like that slammin on someones arm (assualt in my opinion)... in my opinion not that it matters obviously... if police want to scare teenagers there is more ways than slammin doors on there arms... and cussing at them... throwin the authority in peoples faces isnt effective anymore.. it doesnt scare them it just makes them pissed... demoralizing someone so bad that they dont even want to drive on the street anyone in the fear of being harrassed for no reason (me) ... is not helping anyone out... i can see where curfew comes in.. fine out pass curfew do somethin about the curfew... where did all this street racing b.s. come from and the slammin of doors on arms ? .. what has the world come too... tisk tisk tisk...
even though techincally id be on the cops side because out past curfew lol duh ! ... still making accusations and threatning always ticks me off lol
