HE'S THE JUDGE, that's what's up wit that. It's his court, he can pretty much do what he wants. Just like letting you off if he wants. :conf:

Yup, consider the Judge a 'god' over that little court room.

That doesn't happen here in Oklahoma, as the drivers licenses are regulated by out Dept of Public Safety. They are completely separate from the court/judicial system, & also if you get a DUI here, the court part is considered criminal, & the license suspension is considered civil.
If you refuse the requested test in Okla, as is your right, you also give up your license & even if you beat the DUI charge for maybe no test result or whatever, the refusal will still be considered a reason for the license suspension. This has been upheld through the courts, as not being double jeopardy even though it sorta looks like it to some.
Another example would be if you are arrested for DUI & want to appeal losing your license, you or your attorney can request an Implied Consent Hearing, by a Dept of Public Safety officer, but it is somewhat informal as opposed to a regular court hearing, & the guy listens to what we did & listens to the guy or his attorney & then goes back to Okla City & tell everyone they will be notified of his decision. Seems strange, but it works.
