I will try to keep this as brief as possible, but I'd like some advice from the officers as to what I should do. I understand that part of this is a civil matter so you may not want to offer me any advice.
On May 16th I was hit by an 82 year old man that made a turn across my lane of traffic into a driveway. I was going straight and about to approach and intersection and I had the green light. It was a 4 lane road, with 2 lanes in each direction. I was going southbound in the right lane and the guy was stopped in the northbound left lane to make a right turn. He then made his turn crossing into my lane and hit the front driverside quarterpanel on my car.
The police report says that he was in the southbound left lane and attempted to make a right turn and cut across my lane and hit me. Either way you look at it, he crossed into my lane and hit me. Is their anything I can do to have the police report amended to the correct direction of travel and turning, is since its already been written up, I can't do anything about it? The officer did ask for my side fo the story, and I explained how I was in the right southbound lane and the guy was in the left northbound lane making a left turn and hit me. How could the information get mistaken into the guy was in the southbound left lane making a right turn?
In my state (Mississippi) it is required to have insurance or a $1000 fine. The guy that hit me (His name is Virgil) showed an insurance card from Direct General Insurance. I called my insurance company (Nationwide) and started a claim, as well as calling his and starting a claim. Direct General has no insurance policy for Virgil. They don't have his name, phone #, Soc Sec #, or address in their database. I asked them if they could fax me a letter stating that, and they refused to saying that is something they do not do.
My insurance company meanwhile is having my car repaired under my collision policy until they can figure out if this guy has insurance or not. I want my car repaired under uninsured motorist because under collision my rates will go up, and this accident was not my fault, and its pretty obvious that this guy doesn't have insurance because the company he gave does not have a policy for him. Nationwide also said that it looks doubtful that even if they took this guy to court that he would have to pay anything being that he is 82 years old and the car he hit me with was an 87 cadillac deVille (basically I think they are saying he's too poor for them to take him to court and get anything out of him so they'd rather put it under my collision policy and then jack my rates up)
I went to the police department that handled the accident, the Jackson Police Department (JPD). I told JPD how I called his insurance and they don't have a policy for him and said, "that maybe he never had a policy and it was a fake card or his policy expired", and the officers in the precinct building I was in told me to let them do the investigating, not me, and then do the investigating. Then they said to let my insurance company handle it. So I left there and I couldn't get a warrent issued for him not having insurance. Could I also get him for anything because on the accident report it shows him as havign Direct General Insurance, but obviously he doesn't (reporting false records or anything like that?).
I also want to take him to small claims court so that I will get back my deductable. But I think without having proof that he has no insurance and only the accident report, I won't have much luck there either.
What would you suggest I do, if anything?
Edit: I should add that Virgil made 2 claims for Nationwide. One against the damage to his car, and one for injuries his wife sustanied. Nationwide denied both of his claims.
