I was comming east bound on one of the local routes and a car was comming west bound and smashed into me...At first the police report was totally wrong with the directions and date and mph in the zone ect. It was then fixed but ruled my fault..That I cam e over the yellow line..I have a clean record except for a 2 speeding tickets and the other guy had no insurance and had didn't have a valid license due to a DUI in the past.....I stated to the cop I didn't know anything at the time and was just waking up from being unconscious...Why was it my fault even though he didn't have any insurance and no license...And how come the cop never came back for a statement when I was actually there mentally...He told me he only had an hour to write it up from the accident...Is that correct that there is filing deadline for it?........By the way I had a 91 RS v8 couldn't even tell it was a camaro after the wreck, completely totalledand i ended up with a fractured foot and the guy that hit me had a 85 S-10 his vechile wasn't to bad but had two blown ankles, punctured lung and has to get a pin in his shoulder ............So why did the cop make it my fault and can I get around this anyhow becuase I can't afford to loose my insur. with toteing my baby everywhere...Please help

as far as who is at fault not having insurance or not having a license has no bearing. "fault" is what caused the accident,...speeding, not paying attention, trying to beat a red light or crossing into the oncoming lane. none of us were there so it would be impossible for any of us to say why he said you did. did you ? you could talk to the officer and asked how he came to that conclusion, ie witnesses, physical evidence, etc. if you feel that they are wrong let your insurance agent know. either they or you could hire an accident reconstructionist but they arent cheap. if you were at fault you were at fault but a mitigating circumstance (this is where the fault goes from 100% yours to say 50% yours) is the fact the other driver didn't have a license (not valid, suspended or revoked not merely he didn't have it with him) because he shouldn't have been there. just a thought here...since the officer originally had the cars going in the wrong direction it might be that when he corrected it he didn't take that into account. but in the grand scheme of life be GLAD that you walked away..........

What did you have, a head on collession? It sounds like one of you swerved into the others lane and struck him on oncomming.
