Heath0r got stopped for "Disreguarding a stop sign". What are our chances of fighting this in court?
We stopped at the sign and talked about turning left to go get something we left at her aunt christy's house. We decided to go right instead. It was a one lane road that intersected a big four lane road. We turned right and a cop going on the big four lane road pulled a u turn and wrote heath0r for the stop sign, even though we had stopped.
Also, heath0r is very timid. Is there any way I can be her "counsel" in court and talk to the judge or is she going to have to do it?
Couple things. How far back from the stop sign did she stop? If it was too far back, when she ultimately went, it may have appeared that she had run the stop sign. She might be able to convince the judge that you guys were stopped discussing which way to go, but may have been far enough from the stop sign to where it may have appeared to the officer that she had run it if he had just looked over at the right moment. If she gets a sympathetic judge, it might fly.
And I would try to represent her. The judge will look at it like it's none of your business.

Her chance of winning in court is about like my chance of being welcomed at an nethirdgen gathering, so I guess I'll just forget about court.
If it were me I could win it easily. We stopped right at the sign.. it was dark, and there is no way that cop could know for sure if we had stopped or not coming from the angle he was.
Will that ticket raise her insurance? I would think so.. or do they only penalize you for speeding?
Yeah, it's a bitch to win in city court. The judges are paid by the city, so it's in their best interest to make money for the city.
And yes, it's a moving violation, so it shows up on her driving record, which is what insurance companies in Texas use to jack up rates.
