Ok this happened last night, so I'm wondering if any criminal action can happen.

My sister (Suzie) and her bf (Robert) traded cars yesterday because she was late to class and can park his car closer to her school because it doesn't have a parking sticker on it. He was supposed to use her car to go job hunting, but instead picked up some other girl he new and went to new orleans with her. In New Orleans he wrecked her car (flipped it) and fled the scene (I dunno if he got out of the car and ran off, or had a friend come get him, or gave aid to the injured girl and then left after talking to police, or what the details are on anything).

The police in Columbus, MS (where Suzie and Robert share an apt) said that since Suzie gave him the keys that no crime had been committed.

My dad is on his way from Dallas to talk to the New Orleans police cause they won't give him details over the phone about anything.

Do you think any crime has been committed by Robert?

Yes. The crime is "Breach Of Trust" for taking off in the car like that, its less serous then Auto Theft. But i believe it carries jail time. Since he left the scene of a wreck, he can also be charged with 'leaving the scene'.

My best advice to your sister is to first stop seeing him becaus something tells me crap like this will happen often with this guy....

in new york...he didn't. she gave him the keys to "use" the car. irregardless of what he did with it or planned on doing with it. according to the article he was charged with a couple of things (DWI..there's a surprise) and i didn't see leaving the scene among them so it apparently didn't matter or wasn't applicable. and just like kamaro said tell her to dump him, his true colors are showing.......and i do believe kamaro is available..... ;)

Hi,

Just to give you guys an update my sister is going to file a report. It will be on "Unathorized use" or something like that, cause she didn't give him permission to take her car to new orleans. She is also filing a report on Theft because he had her ATM card (he had permission to take out $10 for gas to job hunt) and instead he took out $60 (so he stole $50).

We also found out that because the car was in my step mom's name (her name on the title) she didn't give him permission to drive it. My sister doesn't own it so she can't legally give permission to who can drive it. So, my step mom can charge him with Stolen and Recovery.

it doesnt matter whose name is on the title. your sister, who has permission to use the car as she sees fit, gave him permission to use the car. unless the laws there are vastly different its not going to matter. and she gave him her ATM card and obviously her PIN #, she says it was for $10, he can say it was for $60. the same can be said for what his "purpose" was for having the car. your sister would have to show a "gross deviation" from the "agreement" .......if there was in fact even an "agreement". this is one of lifes lessons........unfortunately learned here by your sister the hardway.
